PHOTON MUUR, et al. vs WEEDMAPS MEDIA, LLC, A DELAWARE LIMITED LIABILITY COMPANY, et al.Re: Motion to Compel Further Responses Tentative Ruling: Denied. Moving party to give notice.Discussion: This seems to be a motion to compel further. As such, moving party must comply with the 8th Amended Standing Order dated 10/10/22 regarding scheduling an Informal Discovery Conference. Further, the Court has concerns that the discovery request in question is duplicative of another for which moving party did not compel. If it is duplicative, then moving party has waived its remedy by choosing not to move to compel timely.Notice of the motion must be given within 45 days of service of the verified response, or upon a later date agreed to in writing. Otherwise, the propounding party waives any right to compel a further response. (Code Civ. Proc., 2031.310, subd. (c).) The deadline cannot be circumvented by asking the questions again. (Professional Career Colleges v. Superior Court (1989) 207 Cal.App.3d. 490, 492.)

The motion to strike is granted. Plaintiff's broad allegations against all defendants fails to meet the specificity required to support a prayer for punitive damages. Plaintiff has 20 days leave to amend.
Defendant's demurrer is moot in light of the granting of the motion to strike.
Counsel for demurring/moving party is to give notice.
